IDEA: The Law Review of
the Franklin Pierce Center for Intellectual Property invites authors to participate in a virtual symposium
focusing on the intersection of Race and Intellectual Property Law. Interested authors should submit their abstracts
via email (listed below) to IDEA by September 25, 2020. The Editors of IDEA will select
submissions to present at a virtual symposium on November 6, 2020, to be hosted
via Zoom. The authors of selected submissions
will present on their topics at the virtual symposium and complete a final
draft of their article for publication in IDEA Vol. 61, Issue 3, to be
published in spring 2021.
Sample topics may include, but are not limited to:
- Underrepresentation of Black and other Minority Groups in Intellectual Property Law/Underrepresentation in Patent Filings
- Offensive Trademarks and Issues in Racism (See, e.g., Matal v. Tam; Iancu v. Brunetti)
- Race “Branding” and Racial Stereotypes in Trademarks
- Inequality of Intellectual Property Protection afforded to Minority Groups in Arts and Music (For example, copyright appropriation in Black music as can be seen in Jazz, Blues and more recently in Rap and Hip-Hop)
- Indigenous Peoples and IP Appropriation (Art, Photos, TV, and Movies featuring the appropriation of Indigenous Peoples’ culture)
- Racial Bias of Facial Recognition Software (Gender Shades, a study by MIT, showed that Facial Recognition is less accurate on non-white skin tones)
